A written listing agreement giving a sole agent the right to sell a property for a specified time, but reserving to the owner the right to sell the property himself without owing a commission. This is a great type of listing for FSBO’s / For Sale By Owner’s. This gives the Owner a chance to sell the property and not pay a commission at the same time list the property in the MLS. This listing is not common, because most property owners require the assistance of a Real Estate Broker with the contract writing, negotiation of the buyers contract, screening of prospective buyers and so on. The difference between an Exclusive Right to Sell and the Exclusive Agency is the ERS is exclusively advertised and sold by the broker, even if the owner finds a buyer, a full commission must be paid. Why would an owner want to list their home this way? Because, beyond finder a buyer, the broker has a fiduciary duty to protect the seller and negotiate the best possible sale in favor of the owner. The representation is one aspect of the listing agreement. These items can be expected to be covered when an owner list their property as an ER or ERS. In an EA Listing, these items must be negotiated with the Real Estate Broker. All items mentioned should be questioned when listing the property as such.
